تنص المادة 744 من القانون المدني على أنه يجوز للأشخاص غير الفاقدين للأهلية القانونية أن يرثوا، في حين تنص المادة 996 على أنه، ما لم ينص الحكم بعدم الأهلية بسبب المرض أو القصور الجسدي أو العقلي على خلاف ذلك، يجوز لأي شخص خاضع للقوامة، بمساعدة القيّم، قبول الميراث، سواء بشكل مطلق أو بموجب قائمة.

Article 744 of the Civil Code states that persons not legally incapacitated may inherit, while article 996 stipulates that, unless the judgement of incapacity on grounds of physical or mental illness or deficiencies provides otherwise, a person under curatorship may, with the assistance of the curator, accept the inheritance, either absolutely or under benefit of inventory.

Según establece el artículo 744 del Código Civil, pueden suceder aquellos que no estén incapacitados por la ley y, según el artículo 996, si la sentencia de incapacitación por enfermedades o deficiencias físicas o psíquicas no dispusiera otra cosa, el sometido a curatela podrá, asistido de curador, aceptar la herencia pura y simplemente o a beneficio de inventario.
