ربما تود اللجنة، لكي توضح بشكل قاطع أن الاقرارات تكون نافذة في الوقت الذي تصبح فيه الاحالة نافذة، أن تنقح المادة 14، الفقرة 1، على النحو التالي: "مالم يتفق .......، يقر المحيل [.....] بأنه وقت ابرام عقد الاحالة....."

In order to make it absolutely clear that representations take effect at the time when the assignment takes effect, the Commission may wish to revise article 14, paragraph 1 along the following lines: “Unless ... the assignor represents [...] that at the time of the conclusion of the contract of assignment: ...” (the position of the words in italics is simply changed).

A fin de dejar bien claro que las garantías implícitas surten efecto al mismo tiempo que la cesión, la Comisión tal vez desee revisar el párrafo 1 del artículo 14, en la versión inglesa, formulándolo del modo siguiente (el cambio no afecta a la versión española): “Unless ... the assignor represents [...] that at the time of the conclusion of the contract of assignment: ...” (las palabras en cursiva han cambiado simplemente de posición).

Pour qu’il soit parfaitement clair que les garanties prennent effet au moment où la cession prend effet, la Commission souhaitera peut-être modifier le paragraphe 1 de l’article 14 comme suit: “Sauf convention contraire entre le cédant et le cessionnaire, le cédant garantit que, à la date de la conclusion du contrat de cession...” (les mots en italiques ont simplement été déplacés).

Для того чтобы абсолютно четко указать, что заверения вступают в силу в момент вступления в силу уступки, Комиссия, возможно, пожелает следующим образом пересмотреть текст пункта 1 статьи 14: "Если ... цедент заверяет [...], что в момент заключения договора уступки: ..." (формулировка, выделенная курсивом, просто переносится в другое место).
