During their mandate, for criminal actions committed within the Community of the Basque Country, they shall not be detained or held except in the case of a flagrant crime, and the Higher Court of Justice of the Basque Country shall, in all cases, be responsible for adopting any decision as to their accusation, remanding in custody, trial and judgment.

Durante su mandato, por los actos delictivos cometidos en el ámbito territorial de la Comunidad de Euskadi, no podrán ser detenidos ni retenidos sino en caso de flagrante delito, correspondiendo decidir, en todo caso, sobre su inculpación, prisión, procesamiento y juicio al Tribunal Superior de Justicia de Euskadi.
