وفي 11 كانون الثاني/يناير 2008، طلب مكتب النائب العام أن تعيد محكمة التحقيق رقم 1 في سبتة فتح القضية في ضوء المعلومات الجديدة التي تشير إلى أن الأحداث المذكورة وقعت على متن سفينة ترفع العلم الإسباني، مما يجعل المحاكم الإسبانية مختصة بالنظر في القضية.

On 11 January 2008, the Office of the Attorney General requested that Examining Court No. 1 of Ceuta reopen the case in the light of new information that indicated that the events in question had taken place on board a vessel flying the Spanish flag, which would render the Spanish courts competent to hear the case.

Con fecha 11 de enero de 2008, la Fiscalía solicitó al Juzgado de Instrucción No 1 de Ceuta la reapertura del procedimiento, ante la existencia de nuevos datos que apuntan a que los hechos se perpetraron a bordo de un buque de bandera española, lo que determinaría la jurisdicción española como competente para el conocimiento de la causa.
