Article 38 of the Constitution of the Republic establishes the institution of the “common-law marriage”, adding that: “The stable and monogamous union of a man and a woman, free of matrimonial ties to another person, who constitute a de facto household for the period and under the conditions and circumstances indicated by law shall generate the same rights and obligations as families constituted through marriage, including with regard to legal presumptions of paternity and joint property”.

El artículo 38 de la Constitución política de la República establece la institución de la "unión de hecho", señalando: "La unión estable y monogámica de un hombre y una mujer, libres de vínculo matrimonial con otra persona, que formen un hogar de hecho, por el lapso y bajo las condiciones y circunstancias que señale la ley, generará los mismos derechos y obligaciones que tienen las familias constituidas mediante matrimonio, inclusive en lo relativo a la presunción legal de paternidad y a la sociedad conyugal".

L’article 38 de la Constitution établit l’institution de l’"union de fait", disposant que l’union stable et monogame d’un homme et d’une femme, libres de tout lien conjugal avec une autre personne, vivant en ménage commun, pendant la durée et aux conditions prévues par la loi, produit les mêmes droits et obligations qu’ont les familles constituées par mariage, notamment en ce qui concerne la présomption légale de paternité et le lien conjugal.
