Regarding the intestate succession of the estate of the adoptee within the second line the adoptive parents and their descendants on the one hand have priority towards the own parents and their descendants on the other hand; in case the adoptee has been adopted only by an adoptive father (an adoptive mother) and the adoptive father (the adoptive mother) or his (her) descendants as well as the own mother (the legitimate father) or her (his) descendants are existing, half of the estate falls to the line of the adoptive father (the adoptive mother) and to the own mother (the legitimate father) respectively.

En cuanto a la sucesión intestada del adoptado en la segunda línea de sucesión, los padres adoptivos y sus descendientes tendrán prioridad respecto de los padres biológicos y sus descendientes; si hay sólo un padre o una madre adoptivos y el padre o la madre adoptivos y sus descendientes así como la madre o el padre biológicos o sus descendientes están vivos, la mitad de la masa sucesoria corresponderá a la línea del padre o la madre adoptivos y la otra mitad a la madre o el padre biológicos.

En ce qui concerne les héritiers ab intestat du second rang de l’adopté, les parents adoptifs et leurs descendants, d’une part, ont priorité par rapport aux parents biologiques et à leurs descendants, d’autre part; si l’adoption a été faite exclusivement par un père adoptif (une mère adoptive) et que celui-ci (celle-ci) ou ses descendants ainsi que la mère biologique (le père biologique) ou ses descendants sont vivants, la lignée du père adoptif (de la mère adoptive) et celle de la mère biologique (du père biologique) héritent chacune pour moitié.
