Regarding the incorporation into the Execution of Sentences Act of the provisions of the Optional Protocol to the Convention concerning the national preventive mechanism, he said that the Corrections Commission had felt that, in practical terms, since the legal system of Liechtenstein was monistic in character, there was no need to amend the law in order to allow that mechanism to play its role.

Concernant l’incorporation des dispositions du Protocole facultatif à la Convention ayant trait au mécanisme national de prévention dans la loi sur l’exécution des peines, M. Zimmerman dit que la Commission pénitentiaire a estimé que, d’un point de vue pratique, comme le système de droit liechtensteinois revêt un caractère moniste, il n’était nullement nécessaire de modifier la loi pour permettre à un tel mécanisme de jouer son rôle.

Что касается внесения положений Факультативного протокола к Конвенции о создании национального превентивного механизма в Закон об исполнении приговоров, то г-н Циммерман говорит, что Комиссия по наказаниям пришла к выводу, что с практической точки зрения и в силу монистического характера лихтенштейнского права нет необходимости вносить поправки в существующий закон, для того чтобы подобный механизм мог играть свою роль.
