(2) Absatz 1 gilt nicht für Ausfuhren in die in Anhang IV aufgeführten Gebiete der Mitgliedstaaten, die nicht Teil des Zollgebiets der Gemeinschaft sind, sofern die Güter von einer Behörde verwendet werden, die sowohl im Bestimmungsland oder -gebiet als auch im Mutterland des Mitgliedstaats, zu dem das betreffende Gebiet gehört, Strafverfolgungs-/Vollzugsbefugnisse hat.

2. Paragraph 1 shall not apply to exports to those territories of Member States which are both listed in Annex IV and are not part of the customs territory of the Community, provided that the goods are used by an authority in charge of law enforcement in both the country or territory of destination and the metropolitan part of the Member State to which that territory belongs.

(2) Az (1) bekezdést nem kell alkalmazni a kivitelre, amennyiben az tagállamok azon területeire irányul, amelyek szerepelnek a IV. melléklet jegyzékében, és ugyanakkor nem tartoznak a Közösség vámterületéhez, feltéve, hogy olyan hatóság által kerülnek felhasználásra, amely mind a célországban vagy célterületen, mind pedig azon tagállam anyaországi részében illetékes bűnüldöző szervként működik, amelyhez az adott célterület tartozik.
