The analysis is made under the general context of differentiation and coordination among different areas of human rights protection. As a consequence, the criminal justice system would not be congested in a dysfunctional way when, in the name of the transitional justice, it is required to reveal and demonstrate the entire circumstances that surround the massive perpetration of international crimes.

El estudio se adelanta en el contexto general de la necesaria utilización coordinada y diferenciada de diversos ámbitos de protección de derechos humanos, de manera que el sistema penal no se sobrecargue disfuncionalmente cuando, a nombre de la denominada justicia transicional, se le pide demostrar todas las circunstancias que han rodeado o rodean la comisión masiva de hechos que constituyen crímenes internacionales.
