The latest memorandum sent by the Romanian Government, and bearing the signature of the Secretary of State Theodora Bertzi, to couples concerned by cases ‘in abeyance’ — i.e. ones in which, at 31.12.2004, the legal situation was more clear-cut owing to the declaration on the possibility of adopting children whose parents had forfeited their parental rights or who were deemed to have been abandoned — states that the legislature has stipulated the sole criterion to be the domicile rather than the nationality of the adoptive parent and child.
