تقر كذلك ما وافق عليه المجلس من إيضاح أن نطاق تنقيح المادة 24 في عام 2006، بشأن إلغاء القيد المفروض على الحق في ضم الخدمة بناء على سنوات الخدمة السابقة، لم يشمل فقط أولئك المشتركين الذين تلقوا تسوية انسحاب، ولكن أيضا أولئك الذين اختاروا استحقاقا تقاعديا مؤجلا (كاملا أو جزئيا) ما دامت لم تدفع مدفوعات الاستحقاق الدورية الخاصة باستحقاقاتهم المؤجلة، على النحو المبين في الفقرتين 329 و 330 من تقرير المجلس، وكما هو مبين في التعديلات الفنية المدخلة على النظام الأساسي للصندوق، المبينة في المرفق الرابع عشر لتقرير المجلس؛

Further approves the agreement of the Board to clarify that the scope of the revision in 2006 of article 24, concerning the elimination of the limitation on the right to restoration based on years of prior service, did not cover only those participants who had received a withdrawal settlement, but also those who had elected a deferred retirement benefit (full or partial) as long as no periodic benefit payments of their deferred benefit had been made, as set out in paragraphs 329 and 330 of the report of the Board, and as clarified in the technical amendments to the Regulations of the Fund, set out in annex XIV to the report of the Board;

Aprueba además el acuerdo del Comité Mixto de aclarar que el alcance de la revisión del artículo 24 hecha en 2006, concerniente a la supresión de la limitación del derecho a revalidación de los años de servicio anterior, no cubriese sólo a aquellos afiliados que hubiesen recibido una liquidación por retiro de la Caja, sino también a aquellos que hubiesen optado por una prestación de jubilación diferida (íntegra o parcial), siempre y cuando no se hubiese realizado ningún pago de su prestación periódica diferida, como se indica en los párrafos 329 y 330 del informe del Comité Mixto, y como se aclaró en las enmiendas técnicas de los Estatutos de la Caja, que se enuncian en el anexo XIV del informe del Comité Mixto;

Approuve en outre le fait que le Comité mixte de la Caisse commune des pensions du personnel des Nations Unies ait accepté de préciser que la modification apportée en 2006 à l’article 24, qui levait les restrictions portant sur le droit à la restitution d’une période d’affiliation antérieure, ne s’appliquait pas seulement aux participants ayant reçu un versement de départ au titre de la liquidation des droits mais aussi à ceux qui avaient opté pour une pension de retraite différée (complète ou partielle), pour autant qu’ils n’aient perçu aucun versement au titre de leur pension différée, comme indiqué aux paragraphes 329 et 330 du rapport du Comité mixte et, plus en détail à l’annexe XIV dudit rapport, où sont exposées les modifications proposées;

одобряет далее согласие Правления пояснить, что сфера действия изменения, внесенного в статью 24 в 2006 году, касающегося отмены ограничения в отношении права на восстановление срока участия в Фонде с учетом ранее проработанных лет службы, охватывает не только тех участников, которые получили расчет при выходе из Фонда, но также и тех, кто предпочел получать отсроченное пенсионное пособие (полное или частичное) при условии, что периодические выплаты их отложенной пенсии не производились, как это изложено в пунктах 329 и 330 доклада Правления1 и как это уточнено в технических поправках к Положениям Фонда, содержащимся в приложении XIV к докладу Правления;

还核准联委会同意澄清,2006年对第24条所作的关于取消对参与人恢复以往缴款工龄的权利的限制的修订,适用范围不仅包括领取离职偿金的参与人,还包括选择(全部或部分)领取递延退休金的参与人,前提是如联委会报告第329和330段所述,并按照联委会报告附件十四所载的《基金条例》技术修正案所说明,参与人尚未定期领取递延养恤金;
