وأشارت جمهورية الكونغو في طلبها، إلى أنها تسعى إلى أن تُقيِّم اختصاص المحكمة، عملا بالفقرة 5 من المادة 38 من لائحة المحكمة، على موافقة الجمهورية الفرنسية، التي ستبديها قطعا.

The Republic of the Congo further stated that it sought to found the jurisdiction of the Court, pursuant to article 38, paragraph 5, of the Rules of Court, on the consent of the French Republic, which will certainly be given.

La República del Congo indicó después que trataría de fundamentar la competencia de la Corte, de conformidad con lo dispuesto en el párrafo 5 del artículo 38 del Reglamento de ésta, “en el consentimiento de la República Francesa, que sin duda se otorgará”.
