For the magistrates of Costa Rica's supreme constiutional court, “regarding authority to determine marriage by proxy, the only unconstitutional element in the view of the Chamber, is the requirement for the Costa Rican to have lived abroad in a couple for a year, since that requirement runs counter to the principle of free will, and runs indirectly counter to the prohibition laid down in article # of the Constitution, by requiring the Costa Rican to have lived outside the country in a conjugal union for at least a year; furthermore, this requirement violates the constitutional principles of reasonableness, rationality and proportionality...”

Para los Magistrados del máximo tribunal constitucional costarricense, “sobre las potestades en cuanto a la determinación del matrimonio por poder, la única inconstitucionalidad que aprecia esta Sala, es la exigencia de que el costarricense deba haber vivido conyugalmente en el extranjero durante un año, ello por cuanto tal exigencia conculca el principio de autonomía de la voluntad, conculcándose indirectamente, la prohibición que contiene el artículo # de la Constitución Política, al exigir que el costarricense haya tenido, fuera del territorio nacional, una convivencia conyugal por un plazo no menor de un año; por otra parte, el requisito comentado, resulta violatorio de los principios constitucionales de racionabilidad, racionalidad y proporcionalidad...”

Pour les magistrats de la Chambre, la seule inconstitutionnalité dans les critères appliqués pour déterminer la validité d'un mariage par procuration réside dans le fait d'exiger que le conjoint costa-ricien ait vécu maritalement pendant un an, hors du territoire, une telle exigence étant contraire au principe de l'autonomie de la volonté et constituant indirectement une violation des dispositions de l'article # de la Constitution; cette obligation constitue également une violation des principes constitutionnels de la rationalité, de la justification et de la proportionnalité
