ومع ملاحظة أن الموقف الإسرائيلي هو أن الاحتلال قد انتهى بالفعل من كثير من الأراضي المحتلة عقب الاتفاقات التي تم التوصل إليها والتي أدت إلى إنشاء السلطة الفلسطينية، وأن الوضع النهائي للمستوطنات في تلك الأراضي مسألة تحل بالمفاوضات بين الطرفين، لا بد من التسليم بأن المنظور الفلسطيني هو أنه إذا ظل للمستوطنات وجود كبير في الأراضي المحتلة، وما دامت القوات العسكرية الإسرائيلية تنتشر لحماية تلك المستوطنات، فلا يمكن القول بإنهاء ذي مغزى للاحتلال

While noting that it is the Israeli position that occupation has in effect ended in much of the occupied territories following the agreements reached leading to the establishment of the Palestinian Authority, as well as the fact that the ultimate disposition of the settlements in those territories is a matter for negotiation between the parties, it needs to be recognized that, from the Palestinian perspective, so long as the settlements remain as a substantial presence in the occupied territories, and Israeli military forces are deployed to protect those settlements, no meaningful end to occupation can be said to have taken place

Отмечая, что, согласно израильской позиции, оккупация фактически прекращена на многих оккупированных территориях после достижения соглашений, ведущих к созданию Палестинского органа, а также тот факт, что окончательное месторасположение поселений на этих территориях является предметом переговоров между сторонами, необходимо в то же время признать, что с палестинской точки зрения до тех пор, пока сохраняется существенное присутствие поселений на оккупированных территориях, а израильские вооруженные силы размещены для защиты этих поселений, нельзя говорить ни о каком реальном прекращении оккупации

以色列的立场认为,在导致建立巴勒斯坦权力机构的协议达成之后它对占领地内多数地区的占领局面已经结束,并认为这些领土上居民点的最终处置是双方谈判的议题,我们在认识到这一点的同时,也必须承认,从巴勒斯坦的观点看,只要定居点在被占领土上仍然广泛存在,并且布署了以色列军队未保护这些居民点,那就不能说占领在实际意义上已经结束。
