The Council understands that, between 15 March to early April 2016, the General Legal Division indicated to the Executive Director of the Office of Administration of Justice and the Principal Registrar that they should direct the Registrars to disregard the 1 March direction of the Judge President, because the view at the time of the General Legal Division was that this direction was ultra vires the Judge President.

El Consejo entiende que, del 15 de marzo a principios de abril de 2016, la División de Asuntos Jurídicos Generales indicó a la Directora Ejecutiva de la Oficina de Administración de Justicia y al Secretario Principal que dieran instrucciones a los Secretarios para que ignoraran la instrucción del Magistrado Presidente de 1 de marzo, porque en ese momento la División de Asuntos Jurídicos Generales estimaba que esa instrucción excedía las competencias de dicho Magistrado.

Le Conseil de justice interne croit comprendre que, entre le 15 mars et début avril 2016, la Division des questions juridiques générales a fait savoir à la Directrice exécutive du Bureau de l’administration de la justice et au Greffier en chef qu’ils devaient donner consigne aux greffiers de ne pas appliquer la consigne du Président émise le 1er mars, au motif que cette dernière constituait un excès de pouvoir.

Насколько известно Совету, в период с 15 марта по начало апреля 2016 года Общеправовой отдел направил Директору-исполнителю Управления по вопросам отправления правосудия и Главному секретарю распоряжение, согласно которому им следует потребовать от секретарей, чтобы они игнорировали указание председательствующего судьи от 1 марта, поскольку Общеправовой отдел тогда полагал, что председательствующий судья не имеет полномочий издавать такое указание.
