وتشكك الدولة الطرف في مصداقية صاحب الشكوى وتدفع بأن مزاعمه غير متسقة وغير معقولة؛ فلا وجود لشهادة طبية أو أدلة موثوقة أخرى تُفيد بأنه تعرض للتعذيب في الماضي؛ وحتى وإن تعرض للتعذيب، فقد كان ذلك في عام 1995؛ أي في وقت ليس بالقريب؛ ولا وجود لأسباب موثوقة تدعو إلى الاعتقاد أنه من فئة الأشخاص الذين يهمون حكومة أوزبكستان أو أنه سيكون معرضاً للخطر بصفة خاصة في حال عودته إلى بلده.

The State party submits that the complainant’s credibility is in question and his claims have been inconsistent and implausible; there is no medical or other credible evidence that he was tortured in the past; even if he had been tortured, this would have been in 1995, i.e. not in the recent past; there are no credible reasons to consider that he fits the personal profile of someone who would be of interest to the Uzbek government or particularly vulnerable if returned to Uzbekistan.

El Estado parte sostiene que la credibilidad del autor es cuestionable y sus afirmaciones han sido incoherentes e inverosímiles; no hay pruebas médicas ni pruebas creíbles de otro tipo de que fuera torturado en el pasado; incluso si hubiera sido torturado, ello habría ocurrido en 1995, es decir, no en el pasado reciente; no hay motivos dignos de crédito para considerar que se ajusta al perfil personal de alguien que pudiera ser de interés para el Gobierno uzbeko o que fuera especialmente vulnerable si regresara a Uzbekistán.
