وينص الدستور على استقلال الجهاز القضائي لا عن الجهازين التشريعي والتنفيذي فحسب بل أيضاً عن سائر القوى السياسية أو الاجتماعية، كما يتجلّى ذلك في الأحكام الدقيقة التي تنظم تعيين القضاة ومدة ولايتهم وأمنهم الوظيفي، والأحكام التي تنظم عزلهم في حال إساءة السلوك وفي القسم الذي يتعيَّن عليهم احترامه بموجب الفصل السابع من الدستور.

The Constitution provides for the independence of the Judiciary not only vis-à-vis the Legislature and the Executive but also vis-à-vis other political or social forces, as illustrated by the entrenched provisions governing the appointment of Judges, their terms of office and security of tenure, the provisions governing their removal in case of misconduct and the oath which they are required to honour under Chapter VII of the Constitution.

La Constitution dispose que le système judiciaire est indépendant tant à l’égard des pouvoirs législatif et exécutif que des diverses forces politiques ou sociales, comme l’attestent les dispositions du chapitre VII, ne pouvant être amendées que selon la procédure prévue dans la Constitution, qui portent sur la nomination des juges, la durée de leur mandat et les termes de leur maintien dans leurs fonctions ainsi que sur leur destitution en cas de faute et le serment qu’ils sont tenus d’honorer.

Конституция предусматривает независимость судебной власти не только по отношению к законодательной и исполнительной власти, но и по отношению к другим политическим или социальным силам, подтверждением чего служат прочно утвердившиеся положения, регламентирующие порядок назначения судей, условия выполнения их должностных функций и гарантии должностной неприкосновенности, положения, регулирующие порядок их отстранения от должности в случае нарушения установленных правил, и клятва, которую они обязаны соблюдать согласно главе VII Конституции.
