ولئن كانت المادة 2 من العهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية لا تشير إلى الإنصاف، فإن مبادئ ليمبورغ بشأن تنفيذ العهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية تنص في تفسيرها لعبارة" إلى أقصى حد تسمح به الموارد المتوفرة لديها"، على وجوب الانتباه، عند تحديد ما إذا اتخذت التدابير الملائمة لإعمال حقوق الإنسان المعترف بها في العهد، إلى الاستخدام المنصف والفعال للموارد المتاحة وسبل الوصول إليها(9).

Although article 2 of the International Covenant on Economic, Social and Cultural Rights does not refer to equity, the Limburg Principles on the Implementation of the International Covenant on Economic, Social and Cultural Rights provide, in their interpretation of “to the maximum of its available resources”, that in determining whether adequate measures have been taken for the realization of the rights recognized in the Covenant, attention shall be paid to equitable and effective use of and access to the available resources.

Aunque en el artículo 2 del Pacto Internacional de Derechos Económicos Sociales y Culturales no se hace referencia a la equidad, los Principios de Limburgo relativos a la aplicación del Pacto, en su interpretación de "hasta el aprovechamiento máximo de los recursos disponibles", disponen que, al determinarse si se han adoptado las medidas adecuadas para la realización de los derechos reconocidos por el Pacto, se deberá prestar atención a la utilización eficaz y equitativa y a la oportunidad de acceder a los recursos disponibles .
