By a judgment of 24 June 1998 the Verwaltungsgerichtshof dismissed Mr Köbler’s action on the ground that the special length-of-service increment was a loyalty bonus which justified a derogation from the provisions on freedom of movement for workers. Mr Köbler brought an action for damages before the Landesgericht für Zivilrechtssachen, Vienna, against the Republic of Austria on the ground that the judgment of the Verwaltungsgerichtshof was contrary to Community law.

Par arrêt du 24 juin 1998, le Verwaltungsgerichtshof a rejeté le recours de M. Köbler au motif que l'indemnité spéciale d'ancienneté constituait une prime de fidélité qui justifiait une dérogation aux dispositions relatives à la libre circulation des travailleurs. M. Köbler a introduit, devant le Landesgericht für Zivilrechtssachen Wien, un recours en dommages et intérêts contre la République autrichienne au motif que l'arrêt du Verwaltungsgerichtshof est contraire au droit communautaire.
