Diese Prüfung hat ergeben, daß der »EMI-UV & Solar Blind Photomultiplier Tube, model G 26 E 314 LF", als nicht wissenschaftliches Instrument oder Gerät im Sinne des Artikels 3 Absatz 1 der vorgenannten Verordnung (EWG) Nr. 1798/75 anzusehen ist; es handelt sich vielmehr um ein Zubehörteil zu einem gefärbten Laser; es ist als »Zubehör" im Sinne des Artikels 3 Absatz 2 Buchstabe a) dieser Verordnung zu betrachten; die Möglichkeit, dieses Zubehörteil von den Zöllen freizustellen, ist daher im Lichte des genannten Artikels 3 Absatz 2 Buchstabe a) zu beurteilen.

Whereas this examination showed that the 'EMI - UV and Solar Blind Photomultiplier Tube, model G 26 E 314 LF', may not be regarded as an instrument or apparatus within the meaning of Article 3 (1) of the aforementioned Regulation (EEC) No 1798/75, but consists in fact of an accessory of a dye laser; whereas the latter must therefore be regarded as an 'accessory' within the meaning of Article 3 (2) (a) of the said Regulation; whereas the possibility of granting importation free of duties must therefore be assessed in the light of the provisions of the said Article 3 (2) (a);

Overwegende dat uit dit onderzoek is gebleken dat de »EMI-UV & Solar Blind Photomultiplier Tube, model G 26 E 314 LF" niet als een instrument of apparaat in de zin van artikel 3, lid 1, van Verordening (EEG) nr. 1798/75 beschouwd kan worden, maar dat het in feite gaat om een toebehoren van een kleurstoflaser; dat dit dus als »toebehoren" in de zin van artikel 3, lid 2, sub a), van dezelfde verordening beschouwd dient te worden; dat dientengevolge de mogelijkheid om dit toebehoren met vrijstelling in te voeren gezien dient te worden in het licht van de bepalingen van voornoemd artikel 3, lid 2, sub a);
