وأفادت لجنة البلدان الأمريكية لحقوق الإنسان بأن قضية بينيتو تايد منديز وآخرون أحيلت في حزيران/يونيه 2012 إلى محكمة البلدان الأمريكية لحقوق الإنسان لأنها رأت أن الدولة لم تمتثل لتوصيات لجنة البلدان الأمريكية لحقوق الإنسان التي تدعو إلى جملة أمور منها مراجعة التشريعات المحلية المتعلقة بتسجيل الأشخاص المنحدرين من أصول هايتية المولودين على الأراضي الدومينيكية ومنحهم الجنسية وإلغاء تلك الأحكام التي لها تأثير تمييزي مباشر أو غير مباشر على أساس الأصل العرقي أو القومي(85).

The Inter-American Commission on Human Rights (IACHR) stated that the Benito Tide Mendez et al. case was sent to the Inter-American Court of Human Rights in June 2012 because it considered the State had not complied with the IACHR’s recommendations, inter alia, to review domestic legislation on inscription and granting of nationality to persons of Haitian descent born in Dominican territory and repeal those provisions that directly or indirectly have a discriminatory impact based on race or national origin.
