ويجب النظر إلى ملاحظات اللجنة فيما يتعلق بصياغة مبادئ القانون الدولي المعترف بها في ميثاق محكمة نورنبرغ وفي حكم المحكمة (مبادئ نورمبرغ)، ومشروع قانون الجرائم المخلة بسلم الإنسانية وأمنها لعام 1954 ومشروع قانون الجرائم المخلة بسلم الإنسانية وأمنها لعام 1996 إزاء الظروف السائدة في ذلك الوقت.

The Commission’s comments in connection with the drafting of the Principles of International Law recognized in the Charter of the Nürnberg Tribunal and in the Judgment of the Tribunal (Nürnberg Principles), the draft Code of Offences against the Peace and Security of Mankind of 1954 and the draft Code of Crimes against the Peace and Security of Mankind of 1996 must be seen against the circumstances prevailing at that time.
