1 Denne sag angår en appel, som Kommissionen har iværksat mod en dom afsagt af Retten i Første Instans, hvorved denne annullerede visse beslutninger, som var truffet under en procedure til besættelse af en ledig stilling, med den begrundelse, at de var blevet truffet med et andet formål end behørigt at opfylde en tidligere dom fra Retten, der annullerede tilsvarende beslutninger, som var truffet under en tidligere procedure til besættelse af den samme ledige stilling.

1 Die vorliegende Rechtssache betrifft ein Rechtsmittel der Kommission gegen ein Urteil des Gerichts erster Instanz, durch das bestimmte Entscheidungen, die in einem Verfahren zur Besetzung einer freien Planstelle ergangen waren, mit der Begründung aufgehoben wurden, daß sie einem anderen Zweck dienten als der redlichen Durchführung eines Urteils des Gerichts über die Aufhebung ähnlicher Entscheidungen, die in einem früheren Verfahren zur Besetzung derselben Planstelle ergangen waren.

1 Η παρούσα υπόθεση αφορά αίτηση αναιρέσεως που άσκησε η Επιτροπή κατά αποφάσεως που εξέδωσε το Πρωτοδικείο και με την οποία ακύρωσε ορισμένες αποφάσεις που είχαν ληφθεί στο πλαίσιο διαδικασίας προς πλήρωση κενής θέσεως λόγω του ότι οι αποφάσεις αυτές επεδίωκαν άλλο σκοπό και όχι την με καλή πίστη συμμόρφωση προς μια απόφαση του Πρωτοδικείου με την οποία ακυρώθηκαν παρόμοιες αποφάσεις που είχαν ληφθεί κατά τη διάρκεια προηγούμενης διαδικασίας για την πλήρωση της ίδιας θέσεως.

1. This is an appeal brought by the Commission against a judgment of the Court of First Instance annulling certain decisions taken in the course of a procedure for filling a staff vacancy, on the ground that they pursued an objective other than that of complying in good faith with a previous judgment of that Court annulling similar decisions taken in the course of an earlier procedure to fill the same vacancy.

1 El presente asunto es un recurso de casación interpuesto por la Comisión contra una sentencia del Tribunal de Primera Instancia que anuló determinadas decisiones, adoptadas en el curso de un procedimiento para proveer plaza vacante, basándose en que perseguían un objetivo distinto del de dar ejecución de buena fe a una sentencia anterior de dicho Tribunal que anulaba decisiones similares adoptadas durante un procedimiento anterior para cubrir la misma plaza vacante.

1 La présente affaire concerne un pourvoi introduit par la Commission à l'encontre d'un arrêt rendu par le Tribunal de première instance qui a annulé certaines décisions prises au cours d'une procédure destinée à pourvoir un emploi vacant au motif qu'elles poursuivaient un objectif autre que celui de se conformer de bonne foi à un arrêt du Tribunal annulant des décisions similaires prises durant une procédure antérieure visant à pourvoir au même emploi.

1 Il presente ricorso è stato proposto dalla Commissione avverso una sentenza con la quale il Tribunale di primo grado ha annullato alcune sue decisioni adottate nell'ambito di una procedura di nomina ad un posto vacante, in quanto dette decisioni hanno perseguito uno scopo diverso dall'esecuzione in buona fede di una precedente sentenza con cui lo stesso Tribunale aveva annullato analoghe decisioni, a loro volta adottate nell'ambito di un precedente procedimento per la copertura del medesimo posto vacante.
