Under the law, the injured-party statement establishes the following rights: the right to be assisted or represented by a lawyer; the right to add any documents to the file; and the right to be notified of discontinuation of the proceedings and the reasons therefor, of the opening of any investigation, and of any declaratory judgement in the investigating or trial courts (article 5 bis, paragraph 3.3, of the Preliminary Title of the Code of Criminal Procedure).

Con arreglo a las disposiciones de la ley, la declaración del agraviado confiere a éste los siguientes derechos: a ser asistido o representado por un abogado; a hacer figurar en autos toda documentación que estime pertinente; a ser informado de que se ha archivado el expediente sin más trámite y de las razones para ello, de que se ha abierto un sumario y de que se han tomado las medidas de fijación ante las instancias de instrucción y judiciales (inciso 3 del párrafo 3 del artículo 5 bis del título preliminar del Código de Procedimiento Penal).
