(1) Die Zertifikatsanmeldung ist bei der für den gewerblichen Rechtsschutz zuständigen Behörde des Mitgliedstaats einzureichen, der das Grundpatent erteilt hat oder mit Wirkung für den das Grundpatent erteilt worden ist und in dem die Genehmigung für das Inverkehrbringen nach Artikel 3 Absatz 1 Buchstabe b) erlangt wurde, sofern der Mitgliedstaat zu diesem Zweck keine andere Behörde bestimmt.

1. The application for a certificate shall be lodged with the competent industrial property office of the Member State which granted the basic patent or on whose behalf it was granted and in which the authorization referred to in Article 3 (1) (b) to place the product on the market was obtained, unless the member State designates another authority for the purpose.

(1) A tanúsítvány iránti bejelentést az abban a tagállamban működő, hatáskörrel rendelkező iparjogvédelmi hatósághoz kell benyújtani, ahol vagy amelynek a nevében az alapszabadalmat megadták, és ahol a termék – 3. cikk (1) bekezdésének b) pontjában említett – forgalomba hozatali engedélyét kiadták, kivéve, ha a tagállam más hatóságot jelöl ki erre a feladatra.

(1) Cererea de certificat trebuie înregistrată la autoritatea competentă în materie de proprietate industrială a statului membru care a acordat brevetul de bază sau în numele căruia a fost acordat și în care a fost obținută autorizația menționată la articolul 3 alineatul (1) litera (b) pentru introducerea pe piață, cu excepția cazurilor în care statul membru desemnează o altă autoritate în acest scop.
