On 13 October 2004, the Ministry of Environment in its written response to the second appeal filed by the communicant with the High Commercial Court of Ukraine stated that the assertion of the plaintiff that Ukrainian legislation provided for an obligation to ensure public participation in the state environmental expertisa was ungrounded.

Le 13 octobre 2004, dans la réponse écrite qu’il a fait parvenir suite au second recours formé par l’auteur de la communication devant la Haute Cour de commerce de l’Ukraine, le Ministère de l’environnement a déclaré que l’affirmation du plaignant selon laquelle la législation ukrainienne prévoyait l’obligation d’assurer la participation du public à l’expertise environnementale d’État était sans fondement.

13 октября 2004 года министерство охраны окружающей среды в своем письменном ответе на вторую кассационную жалобу, поданную автором сообщения в Высший хозяйственный суд Украины, заявило, что утверждение истца о том, что украинское законодательство обязывает государственные органы обеспечивать участие общественности в государственной экологической экспертизе, является беспочвенным.
