وتحيط اللجنة علماً بحجج الدولة الطرف ومفادها أن صاحب البلاغ اعترف باستمرار بمشاركته في ارتكاب الجريمة التي اتهم بها لجميع السلطات القضائية التي أحيل إليها؛ وأنه لم يذكر لقاضي دائرة الاتهام تعرضه للتعذيب إلاّ في 3 حزيران/يونيه 2002؛ وأن القاضي عهد على الفور إلى هيئة الادعاء العام بالتحقيق في هذه الادعاءات؛ وأنه على الرغم من اقتناعه بأن ادعاءات التعرض للتعذيب لا تقوم على أي أساس، فقد وجه مكتب الادعاء الشعبي تهماً ضد أعضاء لجنة التحقيق.

The Committee takes note of the State party’s argument that the author consistently confessed to his participation in the commission of the crime of which he was accused before all the different judicial authorities to whom he was referred; that it is only on 3 June 2002 that the author told the judge of the indictment chamber that he had been tortured; that the judge immediately entrusted the investigation of those allegations to the Department of Public Prosecutions; and that even though it was convinced that the allegations of torture were groundless, the Public Prosecution Office framed charges against the members of the investigation committee.

El Comité toma nota del argumento del Estado parte de que el autor confesó repetidamente haber participado en la comisión del delito del que se lo acusaba en presencia de las diferentes autoridades judiciales ante las que compareció; y que no fue hasta el 3 de junio de 2002 cuando declaró al juez de la sala de acusación que había sido torturado; que este juez encomendó inmediatamente a la fiscalía la investigación de estas afirmaciones; y que aun cuando la fiscalía estaba convencida de que las denuncias de tortura carecían de fundamento, imputó a los miembros del comité de investigación.

Le Comité prend note de l’argument de l’État partie qui fait valoir que l’auteur a systématiquement avoué avoir participé à la commission du crime dont il était accusé, devant toutes les différentes autorités judiciaires auxquelles il a été présenté et que c’est seulement le 3 juin 2002 qu’il a déclaré au juge de la chambre d’accusation qu’il avait été torturé; que le juge a immédiatement chargé le parquet général d’enquêter sur ces allégations; et que, bien qu’étant convaincu que les allégations de torture étaient dénuées de fondement, le parquet général a inculpé les membres de la commission d’enquête.

Комитет принимает к сведению довод государства-участника о том, что автор неоднократно признавал свое участие в совершении инкриминируемого ему преступления во всех судебных органах, перед которыми он представал; что лишь 3 июня 2002 года автор заявил судье Обвинительной палаты о том, что он подвергался пыткам; что судья незамедлительно поручил Департаменту государственного преследования расследовать эти утверждения; и что, даже несмотря на то, что Государственная прокуратура была убеждена в необоснованности утверждений о применении пыток, она предъявила обвинения членам следственной комиссии.
