وترى اللجنة، عموماً، أنه ينبغي النظر إلى العلاقة بين حظر خطاب التحريض على الكراهية العنصرية وازدهار حرية التعبير على أنها علاقة تكامل لا علاقة تَنَافي ذات محصلة صفرية يستلزم إعطاء الأولوية لأحد الطرفين الانتقاص من الطرف الآخر.

In general, the Committee is of the view that the relationship between proscription of racist hate speech and the flourishing of freedom of expression should be seen as complementary and not the expression of a zero sum game where the priority given to one necessitates the diminution of the other.

De manière générale, le Comité estime qu’il conviendrait de considérer que la relation entre l’interdiction des discours de haine raciale et le développement de la liberté d’expression est faite de complémentarité et qu’il ne s’agit pas d’un jeu à somme nulle dans lequel si l’un des éléments gagne en poids, c’est nécessairement au détriment de l’autre.

В целом, Комитет считает, что запрещение ненавистнических высказываний расистского толка и обеспечение свободы выражения мнений должны носить взаимодополняющий характер, а не рассматриваться как противодействующие факторы, когда предпочтение одного из них автоматически означает умаление другого.
