The Committee notes, however, that the Supreme Court decision makes it clear that the Court thoroughly examined each of the grounds for appeal adduced by the author, and that the Court considered that the author’s claim regarding the misrepresentation of facts in a public instrument was valid and accordingly found the author not guilty of that offence and reduced the penalty initially imposed.

El Comité observa, sin embargo, que del fallo del Tribunal Supremo se desprende que éste ha examinado con detenimiento todos y cada uno de los motivos de apelación esgrimidos por el autor, habiendo estimado el motivo relativo a la aplicación indebida del delito de falsedad en documento público, por el que se termina absolviendo al autor de dicho delito y se reduce la pena inicialmente impuesta.

Le Comité note toutefois qu’il ressort de l’arrêt du Tribunal suprême que celui‐ci a examiné avec minutie chacun des motifs de cassation avancés par l’auteur, entre autres le motif relatif à l’application incorrecte du délit de faux en écritures publiques, ce qui l’a conduit à acquitter l’auteur de ce chef et à réduire la peine prononcée par la juridiction de jugement.
