وعن العلاقة بين التطبيق المؤقت والمادة 11 من اتفاقية عام 1969، طرح المقرر الخاص، بعد أن أكد جازماً أنه يجب التمييز بين مفهوم الموافقة على الالتزام بمعاهدة من المعاهدات والتطبيق المؤقت، وبعد أن عرض في هذا الصدد تحليلاً مفيداً للمادة 7 من "الاتفاق بشأن تنفيذ الجزء الحادي عشر من اتفاقية الأمم المتحدة لقانون البحار"، فكرة مؤداها أن أشكال التعبير عن الموافقة على الالتزام بمعاهدة ما، المنصوص عليها في المادة 11 من اتفاقية فيينا لقانون المعاهدات، قد تكون هي نفسها عندما يتعلق الأمر بتطبيقها مؤقتاً.

With regard to the relationship of provisional application to article 11 of the 1969 Vienna Convention, after categorically stating that the concept of consent to be bound by a treaty should be distinguished from provisional application and providing an interesting analysis of article 7 of the Agreement relating to the Implementation of Part XI of the United Nations Convention on the Law of the Sea on that subject, the Special Rapporteur suggested that the means of expressing consent to be bound by a treaty, as provided in article 11 of the 1969 Vienna Convention, might also be used to agree to its provisional application.

En cuanto a la relación entre la aplicación provisional y el artículo 11 de la Convención de 1969, el Relator Especial afirma con rotundidad que debe distinguirse el concepto de consentimiento en obligarse por un tratado de la aplicación provisional y realiza a este respecto un análisis interesante del artículo 7 del Acuerdo relativo a la Aplicación de la Parte XI de la Convención de las Naciones Unidas sobre el Derecho del Mar, tras lo cual expresa la idea de que las formas de manifestación del consentimiento en obligarse por el tratado previstas en el artículo 11 de la Convención de Viena sobre el Derecho de los Tratados pueden ser las mismas para acordar su aplicación provisional.

En ce qui concerne le rapport entre l’application provisoire et l’article 11 de la Convention de 1969, le Rapporteur spécial, après avoir affirmé catégoriquement que la notion de consentement à être lié par un traité doit être distinguée de l’application provisoire et avoir exposé à ce sujet une analyse intéressante de l’article 7 de l’Accord relatif à l’application de la Partie XI de la Convention des Nations Unies sur le droit de la mer, émet l’idée que les modes d’expression du consentement à être lié par le traité prévus à l’article 11 de la Convention de Vienne sur le droit des traités peuvent être les mêmes pour son application à titre provisoire.

Что касается о взаимосвязи между временным применением и статьей 11 Конвенции 1969 года, то Специальный докладчик сначала категорически заявил, что понятие согласия на обязательность договора нужно отличать от временного применения, и изложил в этой связи интересный анализ статьи 7 Соглашения о применении части XI Конвенции Организации Объединенных Наций по морскому праву, а теперь выдвигает идею о том, что способы выражения согласия на обязательность договора, предусмотренные в статье 11 Венской конвенции о праве международных договоров, могут быть такими же и для ее временного применения.
