Traktatens artikel 59 er til hinder for, at en medlemsstat goer en social ydelse i form af boligstoette, navnlig et rentetilskud, betinget af, at de laan, der skal finansiere opfoerelsen, erhvervelsen eller forbedringen af den tilskudsberettigede bolig, er optaget hos et kreditinstitut, der har tilladelse til at drive virksomhed i denne medlemsstat, saaledes at dette forudsaetter, at kreditinstituttet er etableret dér.

Artikel 59 des Vertrages verwehrt es einem Mitgliedstaat, die Gewährung einer sozialen Beihilfe für den Wohnungsbau, insbesondere einer Zinsvergütung, davon abhängig zu machen, daß die Darlehen zur Finanzierung des Baus, des Erwerbs oder der Verbesserung der subventionierten Wohnung bei einem Kreditinstitut aufgenommen wurden, das in diesem Mitgliedstaat zugelassen ist, was voraussetzt, daß es dort niedergelassen ist.

Το άρθρο 59 της Συνθήκης δεν επιτρέπει σε κράτος μέλος να εξαρτά τη χορήγηση κοινωνικής ενισχύσεως υπέρ της κατοικίας, ιδίως την επιδότηση επιτοκίου, από τον όρο ότι τα δάνεια για την επιδοτούμενη χρηματοδότηση της κατασκευής, κτήσεως ή βελτιώσεως κατοικίας πρέπει να έχουν συναφθεί με πιστωτικό ίδρυμα εγκεκριμένο στο εν λόγω κράτος μέλος, όρο που προϋποθέτει την εγκατάσταση του πιστωτικού ιδρύματος στο εν λόγω κράτος.

It is not compatible with Article 59 of the Treaty for a Member State to make the grant of a housing benefit, in particular an interest rate subsidy, subject to the requirement that the loans intended to finance the construction, acquisition or improvement of the housing which is to benefit from the subsidy have been obtained from a credit institution approved in that Member State, which implies that it must be established there.

Artikel 59 van het Verdrag staat eraan in de weg, dat een Lid-Staat de toekenning van een sociale steun voor huisvesting, inzonderheid een rentesubsidie, afhankelijk stelt van de voorwaarde, dat de leningen voor de financiering van de bouw, de aankoop of de verbetering van de gesubsidieerde woning zijn aangegaan bij een in die Lid-Staat erkende kredietinstelling, waarvoor vereist is dat die instelling aldaar is gevestigd.
