فقد آن الأوان لاتخاذ بعض القرارات وطُرحت في هذا الصدد ثلاثة سيناريوهات للنظر فيها: (أ) تقديم توصية لاعتماد الاتفاقية على أساس اقتراح عام 2007؛ و (ب) تسجيل المرحلة التي بلغتها المفاوضات بوضع نص موحد من أجل الحفاظ على ما تحقق من مكاسب، مع الإشارة إلى عدم التوصل إلى توافق في الآراء بشأن النص؛ و (ج) الاعتراف بعدم وجود إمكانية معقولة للتوصل إلى توافق في الآراء في هذه المرحلة، مما سيقتضي إيقاف المفاوضات، دون استبعاد إمكانية قيام وفد أو مجموعة من الوفود بتقديم نص اتفاقية لكي تنظر فيه الجمعية العامة.

The time had come to make certain decisions and three possible scenarios were put forward for consideration: (a) to proceed with a recommendation for the adoption of the convention on the basis of the 2007 proposal; (b) to register the status of the negotiations by putting together a consolidated text in order to preserve the acquis, with an indication that there was currently no consensus on the text; and (c) to acknowledge that there was no reasonable prospect for consensus at the present stage, which would necessitate a pause in the negotiations while also not excluding the possibility of a delegation or a group of delegations bringing up a text of a convention for consideration by the General Assembly.

Había llegado la hora de tomar ciertas decisiones y se plantearon tres posibles opciones: a) adoptar una recomendación para aprobar el convenio sobre la base de la propuesta de 2007; b) dejar constancia de los resultados de las negociaciones mediante la elaboración de un texto consolidado a fin de preservar el acervo, con una indicación de que no se había llegado a un consenso sobre el texto; y c) reconocer que, por el momento, no había posibilidades razonables de consenso, lo que requeriría hacer una pausa en las negociaciones sin excluir por ello la posibilidad de que una delegación o un grupo de delegaciones presentaran un texto de convenio para que la Asamblea General lo examinara.

Le moment était venu de prendre un certain nombre de décisions, et trois scénarios possibles ont été présentés, pour examen : a) formuler une recommandation en vue de l’adoption de la convention sur la base de la proposition de 2007; b) faire le point des négociations en compilant un texte récapitulatif afin de préserver les acquis, en indiquant que, pour le moment, ce texte ne faisait pas l’objet d’un consensus; c) reconnaître qu’au stade actuel, il n’y avait aucune perspective raisonnable de parvenir à un consensus, ce qui nécessiterait une suspension des négociations sans pour autant exclure la possibilité qu’une délégation ou un groupe de délégations soumette un texte de convention à l’Assemblée générale, pour examen.

已到了做出决定的时刻,大家提出三种假设供审议:(a) 继续目前的工作,建议在2007年提案的基础上通过公约;(b) 记录谈判状况,拿出一份合并案文,以保留既得成果,同时说明目前未就案文达成共识;(c) 承认在现阶段达成共识不现实,因此有必要暂停谈判,但同时不排除一个或一组代表团提出供大会审议的公约案文的可能性。
