عندما تكون بحوزة الدفاع أو تحت إمرته مواد أو معلومات خاضعة للكشف، يجوز، في الظروف المشابهة لـلظروف التي تتيح للمدعي العام الاستناد إلى الفقرة 5 من المادة 68، كتمانهـا وتقديم موجـز لها بدلا من ذلك.

Where material or information is in the possession or control of the defence which is subject to disclosure, it may be withheld in circumstances similar to those which would allow the Prosecutor to rely on article 68, paragraph 5, and a summary thereof submitted instead.

Cuando obren en poder de la defensa, o bajo su control, documentos o informaciones que estén sujetos a divulgación, la defensa podrá negarse a divulgarlos si concurren circunstancias análogas a las que permitirían al Fiscal hacer valer lo dispuesto en el párrafo 5 del artículo 68, y presentar en cambio un resumen de dichos documentos o informaciones.
