(5) إذا اتّهم بجريمة يعاقَب عليها بالسجن لمدة تزيد على 10 سنوات، أو السجن لمدة تزيد على 5 سنوات لارتكاب جريمة مصحوبة بعنف، و/أو إذا كان ذلك مبرراً في ضوء الظروف البالغة الخطورة للجريمة؛ وإذا حكمت المحكمة الابتدائية بسجنه لمدة خمس سنوات أو أكثر إذا كانت الظروف البالغة للخطورة للجريمة تبرر ذلك؛
