I kraft af ligestillingen (som er fakultativ) anses stiftelsen af den tinglige brugsret med andre ord for en levering, og det er ikke noedvendigt at tage hensyn til de befoejelser, jf. herved grundsaetningerne i Safe-dommen, som er forbundet med brugsretten til det paagaeldende gode.
