Jeg finder ikke som Parlamentet, at ordene »at bidrage til stoette af Faellesskabets sproglige mangfoldighed« i artikel 1, fjerde led, i den anfaegte retsakt, er tilstraekkelig til, som Parlamentet oensker det, at bringe beslutningen inden for omraadet for »bevarelse og beskyttelse af den kulturarv, der er af europaeisk betydning«, jf. artikel 128, stk. 2, andet led; beslutningen vedroerer - lad det vaere sagt endnu en gang - ikke sproget som et element i »kulturarven«, men som et middel i den oekonomiske aktivitet (18).

Im Gegensatz zum Parlament glaube ich deshalb nicht, daß die Verweisung auf die "Förderung der sprachlichen Vielfalt" in Artikel 1 vierter Gedankenstrich der angefochtenen Entscheidung ausreicht, um die Entscheidung, wie das Parlament dies möchte, auch unter die "Erhaltung und [den] Schutz des kulturellen Erbes von europäischer Bedeutung" im Sinne des Artikels 128 Absatz 2 zweiter Gedankenstrich einzuordnen, und zwar - ich wiederhole es - weil die Sprache in der Entscheidung nicht als Teil des "kulturellen Erbes", sondern als Instrument der unternehmerischen Tätigkeit behandelt wird(18).

Σε αντίθεση με το Κοινοβούλιο, δεν πιστεύω ότι η περιλαμβανόμενη στην τέταρτη περίπτωση του άρθρου 1 της προσβαλλομένης πράξεως αναφορά στην «προώθηση της γλωσσικής πολυμορφίας» αρκεί για να μπορεί να εμπίπτει η απόφαση αυτή, όπως επιθυμεί το Κοινοβούλιο, στον τομέα της «διατηρήσεως και προστασίας της πολιτιστικής κληρονομιάς ευρωπαϋκής σημασίας», κατά την έννοια του άρθρου 128, παράγραφος 2, δεύτερη περίπτωση: επαναλαμβάνω ότι η απόφαση δεν θεωρεί τη γλώσσα ως στοιχείο της «πολιτιστικής κληρονομιάς», αλλ' ως μέσο οικονομικής δραστηριότητας (18).

Unlike the Parliament, I do not therefore consider that the reference to `promotion of linguistic diversity' which we find in the fourth indent of Article 1 of the contested measure is such as to bring the decision - as the Parliament would contend - within the sphere of `conservation and safeguarding of cultural heritage of European significance', within the meaning of the second indent of Article 128(2): and that is so - I repeat - because language is not treated by the decision as part of the `cultural heritage' but as a means by which undertakings conduct business. Diferentemente do Parlamento, não creio que a referência à «promoção da diversidade linguística», que consta do artigo 1._, quarto travessão, do acto impugnado, seja bastante para fazer reconduzir a decisão - como pretende o Parlamento - também ao âmbito da «conservação e salvaguarda do património cultural de importância europeia», na acepção do artigo 128._, n._ 2, segundo travessão: e isto - repito - porque a língua não é tratada na decisão como um elemento do «património cultural», mas sim como um instrumento da actividade económica (18).
