وفيما يتعلق بادعاء انتهاك المادة 9 ترى اللجنة أن المعلومات المعروضة عليها تبين أن ابن عم صاحب البلاغ جرى القبض عليه بدون إبراز أمر رسمي بذلك من قبل ضباط ينتمون إلى الدولة الطرف بأزياء مدنية، ثم جرى احتجازه بدون الاتصال بالخارج وبدون الحصول على خدمات محام للدفاع عنه وبدون أن يحاط علماً البتة بالأسباب الداعية إلى القبض عليه أو بالتهم الموجهة إليه.

With regard to the alleged violation of article 9, the information before the Committee shows that the author’s cousin was arrested without a warrant by plain clothes agents of the State party, was then held incommunicado without access to defence counsel and without ever being informed of the reasons for his arrest or the charges against him.

En relación con la presunta violación del artículo 9, de la información de que dispone el Comité se desprende que el primo del autor fue detenido sin orden judicial por agentes del Estado parte vestidos de civil, y que después estuvo incomunicado sin acceso a un abogado y sin que se lo informara en ningún momento de las razones de su detención ni de la acusación formulada en su contra.

En ce qui concerne le grief de violation de l’article 9, les informations dont dispose le Comité montrent que le cousin de l’auteur a été arrêté sans mandat par des agents de l’État partie en civil, qu’il a ensuite été détenu au secret sans avoir accès à un conseil et sans jamais être informé des raisons de son arrestation ou des charges retenues contre lui.

Что касается возможного нарушения статьи 9, то имеющаяся в распоряжении Комитета информация указывает на то, что двоюродный брат автора был арестован без ордера агентами в штатском государства-участника, затем содержался без связи с внешним миром, без доступа к адвокату и даже не будучи информированным о причинах его ареста или выдвинутых против него обвинениях.
