For at give den nationale ret en relevant besvarelse maa Domstolen derfor efter min opfattelse foerst behandle spoergsmaalet om Raadets fortsatte passivitet paa omraadet for cabotagekoersel, idet det i oevrigt maa understreges, at parterne i hovedsagen, som angaar denne form for transport, ikke i deres indlaeg har beskaeftiget sig med den internationale transport (2).

It therefore appears to me that the need to give the national court an appropriate answer must lead the Court to consider the question of "continuing failure to act" on the part of the Council solely in the area of cabotage by road. It should be pointed out that the parties to the main proceedings, who are engaged in a dispute in this matter, have not referred to the international transport situation. (2)

Il nous semble donc que le souci d' apporter une réponse utile au juge national doit vous conduire à aborder la question de la "carence persistante" du Conseil dans le domaine du seul cabotage routier, étant précisé d' ailleurs que les observations des parties au principal, qui s' opposent dans un litige relatif à ce domaine, n' ont pas évoqué la situation des transports internationaux ( 2 ).

Ritengo pertanto che per fornire una soluzione utile al giudice nazionale dovreste affrontare il problema della "persistente carenza" del Consiglio nel solo settore del cabotaggio stradale, anche perché le osservazioni delle parti nella causa principale, avente ad oggetto una lite relativa a detto settore, non hanno fatto riferimento a questioni di trasporto internazionale (2).
