Den 2 . juli 1987 indankede den civile part, direction nationale des enquêtes douanières, denne dom for Cour d' appel de Versailles, der udsatte afgoerelsen i Shin-sagen ( C-154/88 ) og yderligere ( i tilknytning til det spoergsmaal, der allerede var forelagt af Tribunal correctionnel de Nanterre ) forelagde Domstolen det spoergsmaal, om "... tolden ved import af telte med oprindelse i Korea alene (( skal )) fastsaettes paa grundlag af teltdugens vaegt eller paa grundlag af teltdugens vaegt inklusive tilbehoer ?".

Am 2 . Juli 1987 legte die Direction nationale des enquêtes douanières als Privatklägerin gegen diese Urteile Berufung bei der Cour d' appel Versailles ein, die vor Erlaß eines Endurteils betreffend die Rechtssache Shin ( 154/88 ) den Gerichtshof ergänzend ( zu der bereits vom Tribunal correctionnel Nanterre gestellten Frage ) ersucht hat, die Frage zu beantworten, "ob bei der Festsetzung des Zolls bei der Einfuhr von Zelten mit Ursprung in Korea allein das Gewicht des Zeltgewebes oder das Gewicht des Zeltes einschließlich seines Zubehörs zu berücksichtigen ist ".

On 2 July 1987, the direction nationale des enquêtes douanières, the civil plaintiff, brought an appeal against that judgment before the cour d' appel de Versailles, which, in an interlocutory judgment in Shin Case 154/88, referred to the Court a question ( in addition to the question already referred to the Court by the tribunal correctionnel de Nanterre ) as to "whether, for the determination of customs duty payable on the import of tents originating in Korea, account should be taken only of the weight of the textile material or the total weight of the textile material together with the accessories ".

Le 2 juillet 1987, la direction nationale des enquêtes douanières, partie civile, a interjeté appel de ce jugement devant la cour d' appel de Versailles, laquelle, statuant avant dire droit dans l' affaire Shin ( 154/88 ), a demandé à la Cour à titre complémentaire ( par rapport à la question déjà posée par le tribunal correctionnel de Nanterre ) de dire "si pour la détermination des droits de douane à l' importation des tentes originaires de Corée il fallait tenir compte du poids de la toile de tente seul ou du poids de la toile de tente y compris ses accessoires ".

Il 2 luglio 1987 la direction nationale des enquêtes douanières, parte civile, interponeva appello avverso detta sentenza dinanzi alla Cour d' appel di Versailles la quale, prima di pronunciarsi nella causa Shin ( 154/88 ), ha chiesto alla Corte a titolo complementare ( rispetto alla questione già sollevata dal tribunal correctionnel di Nanterre ), di indicare "se per stabilire i dazi doganali all' importazione di tende originarie della Corea si doveva tener conto solo del peso del tessuto della tenda oppure del peso del tessuto di cui si compone la tenda nonché di quello degli accessori ".

Op 2 juli 1987 stelde de Direction nationale des enquêtes douanières, civiele partij, tegen dat vonnis hoger beroep in bij de Cour d' appel te Versailles, die, alvorens recht te doen in de zaak Shin ( 154/88 ), het Hof als aanvulling ( op de reeds door het Tribunal correctionnel gestelde vraag ) heeft gevraagd "of voor de bepaling van de invoerrechten op tenten van oorsprong uit Korea moest worden uitgegaan van het gewicht van het tentdoek alleen of van het gewicht van de tent met toebehoren ".
