(5) Die nach diesem Artikel in den ersuchenden Staat überstellte Person hat im ersuchenden Staat Anspruch auf sicheres Geleit nach Artikel 23 Absatz 1, bis sie in den ersuchten Staat zurückkehrt, es sei denn, die Person willigt ein, im Rahmen von Ermittlungen, einer Strafverfolgung oder eines anderen als dem im Ersuchen angegebenen Verfahren als Zeuge auszusagen oder an dem Verfahren mitzuwirken, und der ersuchende Staat und der ersuchte Staat stimmen dem zu.

5. The person transferred to the requesting State pursuant to this Article shall enjoy the safe conduct provided for in paragraph 1 of Article 23 in the requesting State until the return to the requested State, unless the person consents to give evidence or assist in any investigation, prosecution or other proceeding, including judicial proceeding, other than the proceeding specified in the request and the requesting State and the requested State agree thereto.

(5) A megkereső állam számára e cikk értelmében átadott személy a megkereső államban a megkeresett állam részére történő visszaszolgáltatásáig a 23. cikk (1) bekezdésében előírt biztosítéknyújtási eljárásban részesül, kivéve, ha az érintett személy hozzájárul ahhoz, hogy a megkeresésben szereplőtől eltérő nyomozás, vádemelés vagy egyéb eljárás – a bírósági eljárásokat is beleértve – keretében tanúvallomást tegyen vagy segítséget nyújtson, a megkereső állam és a megkeresett állam pedig ebbe beleegyezik.

(5) Persoana transferată către statul solicitant în temeiul prezentului articol beneficiază în statul solicitant de imunitatea prevăzută la articolul 23 alineatul (1) până la predarea către statul solicitat, cu excepția cazului în care persoana consimte să depună probe sau să asiste la orice anchetă, urmărire sau alte proceduri, inclusiv proceduri judiciare, altele decât cea specificată în cerere și dacă statul solicitant și statul solicitat convin cu privire la aceasta.
