The essence of all of the complaints before this Tribunal is that on April 26, 1985 the executive pilots as well as the flight attendants were told by Brigadier General Bell of the Canadian Armed Forces that "because of the average age of the group, we were unacceptable to the Department of National Defence". General Bell's role with regard to the transfer of this function from the Department of Transport to the Department of National Defence was obviously critical in the eyes of the complainants. In his examination in chief, General Bell indicated - 9 - that his understanding of the Prime Minister's directive was that the administration of Executive Flight Services would come over to the Department of National Defence and that it was to be done with reasonable speed.

Dans son interrogatoire principal, le général Bell a indiqué qu'à son sens, la directive du premier ministre signifiait que l'administration des services de transport aérien pour dignitaires passerait au ministère de la Défense nationale et que ce transfert devait être effectué avec une diligence raisonnable. Le personnel de ces services devait être traité de façon aussi juste que possible, les objectifs à viser étant l'économie et l'efficience. Le général Bell a alors commandé à l'un des membres de son personnel une étude sur les options susceptibles de se dégager des discussions du groupe de travail interministériel.
