وينص البروتوكول الإضافي أيضاً على أن تعتمد الدول الأطراف تدابير تشريعية وتدابير أخرى تجرم عدداً من الأفعال، بما فيها توزيع المواد العنصرية والكارهة للأجانب أو إتاحتها بطريقة أخرى؛ وإصدار تهديدات بدافع العنصرية وكره الأجانب؛ وتوجيه الشتائم بدافع العنصرية وكره الأجانب؛ وإنكار الإبادة الجماعية أو الجرائم ضد الإنسانية أو التقليل من شأنها إلى حد كبير أو الموافقة عليها أو تبريرها؛ والمساعدة والتحريض على ارتكاب أي من هذه الأفعال.

The Additional Protocol also specifies that States parties are to adopt legislative and other measures that make a number of actions criminal offenses, including distributing or otherwise making available racist and xenophobic material; racist and xenophobic-motivated threats; racist and xenophobic-motivated insults; the denial, gross minimization, approval or justification of genocide or crimes against humanity; and aiding and abetting any of these actions.

Ce Protocole additionnel stipule également que les États parties doivent adopter des mesures législatives et autres érigeant en infractions pénales un certain nombre d’actes – notamment la diffusion ou les autres formes de mise à disposition du public de matériels racistes et xénophobes, les menaces à motivation raciste et xénophobe, les insultes à motivation raciste et xénophobe, la négation ou la minimisation grossière, l’approbation ou la justification de génocides ou de crimes contre l’humanité, ou encore l’aide et l’encouragement à de tels actes.
