b)Ist der Begünstigte eine Behörde eines Partnerlandes im Rahmen der Programme IPA III oder NDICI, deren Kofinanzierung der Verwaltungsbehörde übertragen wird, so kann er nationale Rechts- und Verwaltungsvorschriften anwenden, sofern die Finanzierungsvereinbarung dies gestattet und das wirtschaftlich günstigste Angebot bzw. gegebenenfalls das Angebot mit dem niedrigsten Preis den Zuschlag erhält und zugleich jeglicher Interessenkonflikt vermieden wird.

(b)where the beneficiary is a public authority of a partner country under IPA III or NDICI whose co-financing is transferred to the Managing Authority, it may apply national laws, regulations and administrative provisions, provided that the financing agreement allows it and that the contract is awarded to the tender offering best value for money, or as appropriate, to the tender offering the lowest price, while avoiding any conflict of interests.

b)lorsque le bénéficiaire est une autorité publique d’un pays partenaire au titre de l’IAP III ou de l’IVDCI dont le cofinancement est transféré à l’autorité de gestion, il peut appliquer les dispositions législatives, réglementaires et administratives nationales, pour autant que la convention de financement le permette et que le marché soit attribué à l’offre économiquement la plus avantageuse ou, selon le cas, à l’offre présentant le prix le plus bas, tout en évitant les conflits d’intérêts.
