فإذا لم يتمكن أحد الطرفين من تعيين عضو من أعضاء هيئة التحكيم في غضون شهرين من تعيين الطرف الآخر لعضـــو، يتولى رئيــــس محكمــــــــة العــــدل الدولية تعيينه بناء على طلب هذا الطرف.

If either party has failed to make its appointment of a member of the tribunal within [2] months of the appointment of a member by the other party, the President of the International Court of Justice shall make such an appointment at the request of such a party.

Si cualquiera de las partes no hubieran nombrado a un árbitro del tribunal dentro de los dos meses siguientes al nombramiento de un árbitro por la otra parte, el Presidente de la Corte Internacional de Justicia efectuará dicho nombramiento a petición de esa parte.
