The decision rendered by the Fourth Superior Court of Justice of the Third Judicial District on February 7, l986, is the only jurisdictional decision which has the effect of reviewing the investigation, and that decision, as we have already indicated, led to a relative or temporary closing, which pursuant to Article 2l38 of the Judicial Code in force at the time to Article 22l3 of the current Judicial Code, is subject to the principle that the procedure continues and to exist only when the possibility of criminal is invalidated by negative prescription and the closing therefore becomes final.

El auto de 7 de febrero de l986 proferido por el Cuarto Tribunal Superior de Justicia del Tercer Distrito Judicial, es la única decisión jurisdiccional que tiene la virtud de calificar la investigación y dicha decisión, como ya lo hemos expresado, determina un cierre relativo o provisional que, conforme lo dispone el Artículo 2138 del Código Judicial vigente en aquella fecha, y conforme lo dispone el Artículo 2213 del actual Código Judicial la institución de la reapertura del proceso subsiste, y únicamente fenece cuando la acción penal prescribe convirtiendo dicho cierre en definitivo.
