In contrast to the Board of Appeal’s submissions in paragraphs 96 and 97 of the contested decision, the fact that the multifunctional goods marketed by the intervener were sold not only by cutlers but also by gunsmiths, tobacconists’ shops, shops specialising in writing articles, shops dealing in ‘gifts — tableware’, department stores and other undertakings is not capable of altering the nature of these articles as goods falling within the cutlery sector.
