Según se desprende del considerando 457 de la Decisión impugnada, Eni fue condenada en su condición de sociedad matriz última del grupo, titular, en parte directamente y en parte indirectamente, de entre el 99,93 y el 100 % del capital de las sociedades responsables de la actividad de caucho de cloropreno del grupo, a saber, EniChem Elastomeri, EniChem, posteriormente [confidencial], y después, Polimeri Europa, posteriormente Versalis, puesto que existían otros elementos que corroboraban igualmente que ejercía una influencia decisiva sobre dichas filiales.
