40 La continuità funzionale, richiamata nella giurisprudenza del Tribunale [sentenze del Tribunale 23 settembre 2003, causa T‐308/01, Henkel/UAMI – LHS (UK) (KLEENCARE) (Racc. pag. II‐3253, punti 25 e 26); 1° febbraio 2005, causa T‐57/03, SPAG/UAMI – Dann e Backer (HOOLIGAN) (Racc. pag. II‐287, punto 18), nonché sentenza 10 luglio 2006, causa T‐323/03, La Baronia de Turis/UAMI − Baron Philippe de Rothschild (LA BARONNIE), Racc. pag. II‐2085, punti 57 e 58], non può in ogni caso giustificare la presentazione di una tale richiesta, per la prima volta, dinanzi alla commissione di ricorso, giacché questa non comporta affatto un esame da parte della commissione di ricorso di una causa diversa da quella sottoposta alla divisione d’opposizione, ossia una causa la cui portata sarebbe stata ampliata dall’aggiunta della questione preliminare dell’uso effettivo del marchio anteriore.
