It must be recalled that, according to the case-law, extending the protection of a national mark by registering it as an EU mark is part of an undertaking’s normal commercial strategy (see, to that effect, judgments of 1 February 2012, Pollo Tropical CHICKEN ON THE GRILL, T‐291/09, EU:T:2012:39, paragraph 58, and of 14 February 2012, Peeters Landbouwmachines v OHIM — Fors MW (BIGAB), T‐33/11, EU:T:2012:77, paragraph 23).
