The GOC claimed that the Commission failed to establish that SOCBs posses, are vested with, and exercise governmental authority and that it has not established i) that the functions in question which are alleged to be performed by the SOCBs are those that are executed by a government in general, i.e. are governmental functions in the first place, ii) the common features which the SOCBs share with the government besides the shareholding which was also not established for all the SOCBs; and iii) that all the SOCBs posses the requisite governmental authority in order to be able to exercise it or were vested with the power to execute the governmental functions concerned.
De GOC betoogde dat de Commissie niet heeft aangetoond dat de handelsbanken in staatsbezit overheidsautoriteit bezitten, deze uitoefenen en dat niet is vastgesteld i) dat de desbetreffende functies waarvan wordt gesteld dat deze door de handelsbanken in staatsbezit worden uitgeoefend, in het algemeen door een regering worden uitgeoerend, d.w.z. in de eerste plaats regeringsfuncties zijn, ii) welke algemene kenmerken de handelsbanken in staatsbezit delen met de overheid, naast het aandeelhouderschap dat ook niet voor alle handelsbanken in staatsbezit is vastgesteld, en iii) dat alle handelsbanken in staatsbezit beschikken over de vereiste overheidsautoriteit om deze uit te kunnen oefenen of dat hen de bevoegdheid is toegekend om de desbetreffende overheidsfuncties uit te oefenen.EurLex-2 EurLex-2
